What is Power of Attorney Attestation?

A Power of Attorney (POA) is a legal document that authorises one person (the agent or attorney-in-fact) to act on behalf of another (the principal) in legal, financial, or property matters. When the POA is to be used in another country — particularly Gulf nations or Europe — it must first be attested by multiple government authorities to be recognised as valid abroad.

POA attestation is the process of getting official government stamps from the Notary, State Home Department or SDM, Ministry of External Affairs (MEA), and the destination country's embassy in India. For Gulf countries, a final MOFA (Ministry of Foreign Affairs) stamp in the destination country is also required.

This is especially important for NRIs who need a trusted person in India to sell property, operate bank accounts, manage investments, or handle legal proceedings on their behalf while they are abroad.

Do I need to be present in India to get my POA attested?
No. If you are an NRI living in the Gulf or abroad, you can execute the POA at the Indian Embassy or Consulate in your country of residence, or grant a limited POA to a trusted representative in India. We then handle all subsequent attestation steps — SDM/Home Dept, MEA, Embassy — entirely in India on your behalf without requiring your travel.
What is the difference between a General POA and a Special POA?
A General Power of Attorney (GPOA) grants broad authority across multiple matters — property, banking, legal, company affairs, etc. A Special or Specific POA is restricted to one particular transaction (e.g., selling one specific flat in Kochi). Both require the same attestation chain: Notary → SDM/Home Dept → MEA → Embassy. The cost and timeline are similar for both types.
Is POA attestation required for NRI property sales in India?
Yes. If you are an NRI in UAE, Qatar, Kuwait or elsewhere and want to sell property in India through a representative, the Special POA must be attested by the Indian Embassy in your country of residence, and then MEA-attested in India. Without proper attestation, Indian sub-registrar offices will not register the sale deed. We handle this process end-to-end.
How long is an attested POA valid?
The attestation stamps themselves do not expire, but the legal authority granted by the POA may be revoked at any time by the grantor. For Gulf country use, financial institutions and government bodies generally prefer POAs not older than 1 year. Indian sub-registrar offices typically accept POAs up to 2 years old. We recommend re-attestation if your POA is more than 12 months old for Gulf use.
Can I use MEA Apostille instead of embassy attestation for my POA?
Only for Hague Convention member countries — UK, Germany, France, Netherlands, USA, Canada, Australia, etc. Gulf countries (UAE, Qatar, Kuwait, Saudi Arabia, Oman, Bahrain) are not members of the Hague Convention, so apostille is not accepted there. Full embassy attestation followed by MOFA is mandatory for all Gulf countries.
What if my POA was executed at an Indian Embassy abroad — does it still need attestation?
Yes. A POA executed and notarised at an Indian Embassy or Consulate abroad (e.g., Indian Embassy in Dubai, Indian Consulate in Jeddah) already carries the Consular seal, which is equivalent to embassy attestation for use in India. However, if the document needs to be used back in the destination Gulf country for legal proceedings, MOFA attestation in that country is still required. What documents do I need to submit for POA attestation?
Standard documents required: original notarised POA, 2 self-attested photocopies, passport copy (first and last page) of both the principal and the agent, Gulf residence visa copy if you are abroad, passport-size photographs, and for property POA, a copy of the property title.
